I got this in my email today.

Empire Online has taken the decision to stop promoting CDpoker from the 1st of November 2006. This means that from this date we will no longer pay CPA or commission for players who signed up after the 1st of November and the option to promote CDpoker through Tradal.net will be removed.

This does not affect in any way our lifetime revenue agreement for existing players, they will continue to play on CDpoker and you will receive your monthly commission as usual and stats will still be available on Tradal.net.

Players who signed up prior to the 1st of November but deposited after will still be credited to you both for CPA and Revenue Share structures.

We will continue our commitment for excellence and high performances with our strong poker brand- NoblePoker.com.

Yours sincerely,

EmpireOnline affiliate team

They will probably start dropping like flies any time soon!

The U.S. has taken this step to make it virtually impossible to offer real money entertainment to U.S. customers. It is doubtful that the U.S. authorities will achieve their stated goals by introducing such legislation. We believe that a properly monitored forward-looking regulation would be much more effective than this general ban.

As a result of this new law, a lot of poker and casino sites no longer accept real money deposits from any NEW U.S.players.

Depositing Restrictions

As officially stated before poker and casino sites have been working on a technical solution to restrict all customers within the U.S. from depositing new funds at any of the PokerAffiliate.com brands. This solution will be implemented on Wednesday, October 25th.

Real Money Restrictions

Poker and casino sites will have implemented the technical solution to restrict all customers within the U.S. from accessing our real money games starting Monday, November 6th. After that time players will still be able to login to the site, participate in play money games and withdraw funds from their account.

If you are a U.S. affiliate currently receiving your affiliate payouts to your player account, then you will need to change your payout option. You can change this to Neteller, Moneybookers or check.

Poker and casino sites are of course very sorry for this development and hope for the time that we can work with all our affiliates again to recruit U.S. players to our real money games, as we are aiming to offer real money games as soon as the legislation allows us to.
Poker and casino sites will do their utmost to continuously keep you up to date with future developments.

I sent in the letter to my local Representataive that goes like this, It’s a form letter you get when you click on a link when you log into partypoker.com

To Whom It May Concern

I am a voter, I am a poker player and I am mad.

Under your watch, Congress passed legislation that prohibits me from playing the great game of poker on the Internet. Legislation that impacts millions online poker players in the United States like me deserves more debate than a back-room deal. You have an opportunity to correct this injustice.

Poker is a great American game with deep roots in this country. Throughout history presidents, generals, Members of Congress, Supreme Court justices and average citizens have enjoyed poker with family and friends. Poker is what I like to do for entertainment, just like a round of golf or going to a movie.

Unlike other forms of gambling, poker is not a game of chance. It is a game where performance is merited and a community game where the “house” is not your competition. These are real and significant differences. Simply putting the word “Internet” in front of poker does not change the qualities of the game and it should not make the people who play it suspect.

I am urging you to support amending this new Internet gambling law so that it has an exemption for poker. Please note, that other forms of Internet gambling such as horseracing, lotteries and fantasy sports are already protected under this law. An exemption for poker is not unreasonable, it is good public policy and would help preserve and protect an American tradition.

I look forward to your support for a poker exemption.

Again, I am a voter, I am a poker player and I remember.

Faithfully,
I sure hope it makes a difference.

Well, forget about retiring as an affiliate for poker sites. A friend of mine sent me this email from one of the biggest poker affiliates on the web.

What does this mean for you as our affiliates?
US customers will no longer be able to play for Real Money at any of our gambling sites. As such, there will be no revenue shares paid out to new or existing players within the US and no Cost Per Acquisition paid out to any new US players. You can still continue to promote to non US-based customers and even if you are a US affiliate, the law applies to customers in the US and not affiliates.

What will happen to affiliate earnings?
Your payouts up until October 16 have been paid out as usual. From now on, you will be paid out for all future non-US players only with your usual revenue share or CPA.

What does this mean for the future?
As a PokerAffiliate.com we encourage you to explore the huge potential in continuing to promote our brands to the non-US market. We have been working for some time to broaden market exposure and we have managed to increase the non US customer base significantly with the help of our partners. For more details, please see the press release that was made public on Friday October 13th.

What is PokerAffiliate.com doing for the future?
PokerAffiliate.com have worked with the brands we promote to ensure that we already have strong markets in key regions throughout the world, and we will now work even harder to promote other regions and focus on new and emerging markets. We will soon be offering even more marketing tools and help for you to work on pursuing growth in other international markets. Watch out for new languages, games, and features very soon.

We thank you for all your hard work in helping to promote our brands to US players through PokerAffiliate.com and look forward to working with you in the future to recruit players from the rest of the world. If you have any questions regarding this matter, please contact your account manager.

This legislation was signed into law by President George Bush on October 13, 2006. On 30 September 2006 the US Senate passed the SAFE Port Act which also contains a section referred to as the Unlawful Internet Gambling Enforcement Act of 2006. The new act primarily affects online payment transactions for games of chance, which have been deemed unlawful under US American law, and aims to prevent these by threatening severe punishment, court sanctions and regulatory action. This statute adds a new subchapter to Chapter 53 of the United States Code stating that online games of chance are primarily financed through credit card payments and money transfers and that new enforcement tools have become necessary for the Internet. Not only sports bets, but also games of chance and lotteries, are affected by the bet or wager definition. The law makes payment transactions related to unlawful online games of chance virtually impossible, listing all payment options affected in detail as is customary for US legislation. In addition, § 5367 also contains a provision about the liability of any company or person involved in such transactions. This also applies to operations owned or controlled by someone who accepts unlawful bets and wagers. Ongame, one of the companies in the bwin Group is also affected by the bill which was signed into law today by President George W. Bush. bwin regrets that the US has taken this step which will make it virtually impossible for listed, strictly regulated and transparent operators to offer real money entertainment to US customers. bwin is doubtful whether US authorities will be able to achieve their stated goals – protection of minors and the prevention of gaming addiction – by introducing such legislation. Past experience with restrictive measures to prevent the abuse of alcohol has shown that such prohibition did not have the desired effect, merely driving consumers underground and contributing to the rapid growth of an entirely unregulated black market. The online gaming industry is unanimous in its view that the creation of forward-looking regulation can more effectively address issues such as consumer protection, the protection of minors, the prevention of gaming addiction, or the prevention of money laundering. Such a policy, if properly monitored by the authorities, would be much more effective than this general ban. Following an in-depth analysis of the situation and extensive legal consultation, bwin has decided to comply with the new legislation and will no longer accept any new US-resident customers for its real money gaming products, effective immediately. The company is working on technical arrangements that will prevent existing customers from accessing its real money games. Until further notice, bwin will only be offering a play money line-up to the US market. The greatly increased risk of prosecution by the US authorities, the considerable pressure on banks and payment providers coupled with the requirements for publicly listed companies leave the company no other option. For the year 2006 the Ongame customer base also includes some 177,000 active real money customers not resident in the US. In addition, the majority of customers in Ongame’s poker network are from Europe. In Q2 2006, the former Ongame customer portfolio generated gross gaming revenue of EUR 29.0 million. EUR 9.3 million or 32 percent of the gross gaming revenue were generated from customers not resident in the US. Cumulative gross gaming revenue of the bwin group amounted to EUR 94.3 million in Q2 2006; as leading provider of online gaming entertainment in continental Europe, bwin generated 79 percent of its gross gaming revenue through customers not living in the US in Q2 2006. bwin customers not resident in the USA are not affected at all by these legislative changes in the United States, and can continue to enjoy the full range of bwin products. The bwin Group has over 10 million registered customers (including 7 million play money customers) in over 20 core target markets. Operating under international and regional licences in countries like Gibraltar, Kahnawake (Canada), Belize and Germany, Italy, Mexico, Austria and the United Kingdom, the Group has set itself the goal of becoming the number one address for sports betting, games and entertainment via digital distribution channels. The Group offers sports betting, poker, casino games and soft games, as well as audio and video streams on top sporting events like, for example, the German Bundesliga. The parent company bwin Interactive Entertainment AG has been listed on the Vienna Stock Exchange since March 2000 (ID code BWIN, Reuters ID code BWIN.VI). Further information about the Company can be found on its investor relations website at www.bwin.ag.

When I logged into party poker this afternoon, I got this message:

The President of the United States has signed legislation that now causes PartyGaming to have to cease taking wagers from U.S. customers. We will also suspend accepting deposits from U.S. customers and examine potential offerings to U.S. customers that would be within the new law. This will not affect the Play For Free games and your Account will remain accessible.

Non-US players and all Play for Free games will not be affected.

If the U.S. would just allow us to play online poker and other things like online casinos, they would get revenue generated from the U.S. citizens that play on these gaming sites. But the religious right-windged folks won’t allow for this. Are they going to ban BINGO now? Is the U.S. affraid they are going to lose money if they allow citizens to play on online gaming sites? Well, they have been missing out because they don’t allow us.

The Poker Show I watch are Ultimate Poker Challenge and what ever else they decide to play on NBC. Like the Heads Up Tournament whatever they have on now. Don’t get to see the WSOP though. I hope I can make it thie year.
